decisions api · hearsay · 94 items

21 of 94 hearsay items came back refused.

The note

Fig. 1 One square per hearsay item.

"status": "refusal". That was the whole response for item hearsay-7 in my pilot: no answer, no reason text.

In the full run of 544 legal yes or no questions through OpenAI's Decisions API, 21 came back that way, all of them among the 94 hearsay items. None of the other five tasks drew a single refusal.

The headline number holds up on its own terms. Drop the refusals, which is what the headline does, and hearsay accuracy reads 74 percent on 73 answered items.

Underneath, the denominator quietly shrank by a fifth, and not evenly. Eighteen of the 21 refused items carry the label no in the benchmark, a split derived from the label counts because the refused rows are not in the public repo. Score a refusal as a no and the model is right on 18 of them for free. Score it as a yes, wrong on 18.

On the ten-item pilot, one item answered under LegalBench's one-line hearsay prompt was refused under the four-sentence statement of the rule that the full run then used.

Limits. The pilot is ten rows. The 18 and 3 split is derived from the label counts, not read off the rows. Why the model refused is not recorded anywhere; the response carries no reason.

If 21 of 94 items can leave a denominator with no reason attached, should an accuracy figure ever be printed without the refusal count beside it?
